Effective as of the date you first access or use Carnostic’s services
By accessing or using Carnostic’s website, reports, data, files, APIs, or any related services (collectively “Services”), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service (“Terms”). If you do not agree, you must not access or use the Services.
Carnostic provides informational vehicle-valuation content intended solely for personal, non-commercial decision-support. Carnostic is not a licensed appraiser, broker, dealer, insurer, or financial adviser, and does not buy, sell, finance, or insure vehicles. All outputs are general information, not professional, financial, or legal advice.
You affirm that you are at least 18 years old and legally able to enter into these Terms. You agree to provide accurate information and to comply with all applicable laws when using the Services.
You are solely responsible for: the accuracy of any data, documents, photographs, or links you submit; how you interpret, rely on, or act upon any Carnostic output; compliance with local laws, including disclosure obligations when sharing Carnostic materials. You must not: (a) misuse, scrape, reverse-engineer, or interfere with the Services; (b) resell or commercially exploit any Carnostic content without prior written consent; or (c) upload material that is unlawful, infringing, or harmful.
All software, reports, text, graphics, logos, and trademarks are the exclusive property of Carnostic or its licensors. Carnostic grants you a limited, non-exclusive, non-transferable, revocable license to view and download reports for your personal use only. All other rights are reserved.
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” CARNOSTIC DISCLAIMS ALL WARRANTIES—EXPRESS, IMPLIED, OR STATUTORY—INCLUDING, WITHOUT LIMITATION, WARRANTIES OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. CARNOSTIC DOES NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY RESULT WILL BE ACCURATE OR RELIABLE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARNOSTIC, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES—INCLUDING LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR VEHICLE-PURCHASE LOSSES—ARISING OUT OF OR IN CONNECTION WITH THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. CARNOSTIC’S TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICES SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).
You agree to defend, indemnify, and hold harmless Carnostic and its affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of: (a) your use or misuse of the Services; (b) your breach of these Terms; or (c) your violation of any law or third-party rights.
The Services may reference third-party websites, data, or services. Carnostic does not control or endorse third-party content and assumes no responsibility for it. Accessing third-party resources is at your own risk.
Carnostic may suspend or terminate your access to the Services at any time, for any reason, without notice. Upon termination, all rights granted to you under these Terms cease immediately. Sections that, by their nature, should survive termination (including Disclaimers, Limitation of Liability, Indemnification, and Governing Law) shall survive.
These Terms are governed by and construed under the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. Any dispute arising out of or relating to the Services or these Terms shall be resolved exclusively in the state or federal courts located in Wilmington, Delaware, and you consent to personal jurisdiction and venue in those courts.
Carnostic may modify these Terms at any time by posting an updated version on its website. Continued use of the Services after updated Terms become effective constitutes acceptance of the changes.
These Terms constitute the entire agreement between you and Carnostic regarding the Services and supersede all prior or contemporaneous agreements, communications, and understandings.
If any provision of these Terms is held invalid or unenforceable, that provision shall be struck and the remaining provisions enforced. Carnostic’s failure to enforce any right or provision is not a waiver of such right or provision.
